The Scottish Ministers, in exercise of the powers conferred by sections 1, 7(1) and (2) and 23(f) and (g) of the Animal Health Act 1981[1], and of all other powers enabling them in that behalf, hereby make the following Order: Citation, commencement and extent 1. - (1) This Order may be cited as the Diseases of Animals (Approved Disinfectants) Amendment (Scotland) Order 2003 and shall come into force on 30th June 2003. (2) This Order extends to Scotland only. Amendments to the Diseases of Animals (Approved Disinfectants) Order 1978 2. - (1) The Diseases of Animals (Approved Disinfectants) Order 1978[2] shall be amended as follows:-
(b) in article 4 (approved disinfectants), for "Schedule 1" substitute "either Schedule 1 or Schedule 2"; (c) at the end of article 5(3) (disinfectants listed in Schedule 1) insert-
6. - (1) A disinfectant listed in column 1 of Schedule 2 is approved for use, and may be used, only under and for the purposes of an order in the column relating to which (in that Schedule) a dilution rate is specified opposite the name of that disinfectant, and may, subject to the provisions of article 8, be used under an order only at the dilution rate so specified. (2) A disinfectant listed in column 1 of Schedule 2 shall remain an approved disinfectant until 31st August 2003."[3];
(f) after Schedule 1 insert the Schedule set out in Schedule 2 to this Order.

(This note is not part of the Order) This Order, which extends to Scotland only, amends the Diseases of Animals (Approved Disinfectants) Order 1978 ("the 1978 Order"). Its effects are to substitute for Schedule 1 to the 1978 Order the Schedule 1 in this Order and to add a Schedule 2 to the 1978 Order (article 2). Schedule 1 provides an updated list of disinfectants approved by the Scottish Ministers. Schedule 2 lists disinfectants which, although no longer approved, can continue to be used as approved disinfectants until 31st August 2003. The Order also makes consequential amendments and revocations (articles 2 and 3). This Order was notified in draft to the European Commission in accordance with Directive 98/34/EC (O.J. No. L 204, 21/07/98, p.37) as amended by Directive 98/48/EC (O.J. No. L 217, 05/08/98, p.18). A Regulatory Impact Assessment has not been prepared in respect of this Order.
