The National Assembly for Wales, in exercise of powers conferred upon it by sections 16BB(2), (3) and (5) and 126(4) of the National Health Service Act 1977[1] hereby makes the following Regulations: Citation, commencement and application 1. These Regulations may be cited as the Powys Local Health Board (Additional Functions) Regulations 2003 and come into force on 1st April 2003 and apply to Wales only. Interpretation 2. In these Regulations, unless the context otherwise requires -
(b) the management of community health services provided from Bronllys Hospital, Bronllys, Powys, LD3 0LU and the ownership of associated premises; and (c) functions of managers under the Mental Health Act 1983[4].
Functions to be exercised by Powys Local Health Board (This note is not part of the Regulations) The Local Health boards (Functions) Regulations 2003 (S.I. 2003/150 (W.20)) conferred upon Local Health Boards established for all areas of Wales pursuant to section 16BA of the National Health Service Act 1977 certain specified functions. These Regulations confer upon Powys Local Health Board certain additional functions being functions previously undertaken by the Powys Health Care National Health Service Trust ("the trust"). The trust was dissolved by the Powys Health Care National Health Service Trust (Dissolution) Order 2003 (S.I. 2003/817 (W.20)). Notes: [1] 1977 c.49. Section 126(4) was amended by the 1990 Act, section 65(2) and the 1999 Act, Schedule 4, and paragraph 37(6). Section 16BB was inserted by section 6 of the National Health Service Reform and Health Care Professions Act 2002 (c.17)back [2] Established under section 16BA(1) of the National Health Service Act 1977 by S.I./2003/148 (W.18).back [3] The assets, rights and liabilities of the Powys Health Care National Health Boards (Transfer of Property, Rights and Liabilities)(Wales) Trust were transferred to the Board by the Local Order 2003 (S.I. 2003/473 (W.20)).back [4] 1983 c.20 ("the 1983 Act"); the expression "managers" has the meaning assigned to it by section 145(1) of the 1983 Act.back
