The Control of Pollution (Revocations) Regulations 1989

Made 6th July 1989
Laid before Parliament 7th July 1989
Coming into force Immediately before 1st September 1989

    The Secretary of State for the Environment and the Secretary of State for Wales, acting jointly in exercise of the powers conferred on them by section 30(5), as applied by section 56(6), and sections 35(2), 36(5) and 6(b), 39(4) and (5), 40(5), 41, 42(1)(a), 55 and 104(1) of the Control of Pollution Act 1974[1] , and of all other powers enabling them in that behalf, hereby make the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Control of Pollution (Revocations) Regulations 1989 and shall come into force immediately before 1st September 1989.
    Revocation of Regulations
        2.    The following Regulations are hereby revoked insofar as they apply to England and Wales -
       (a) the Control of Pollution (Radioactive Waste) Regulations 1984[2] ;
       (b) the Control of Pollution (Consents for Discharges) (Secretary of State Functions) Regulations 1984[3] ;
       (c) the Control of Pollution (Discharges by Authorities) Regulations 1984[4] ;
       (d) the Control of Pollution (Radioactive Waste) Regulations 1985[5] ; and
       (e) the Control of Pollution (Registers) Regulations 1985[6] .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations revoke the statutory instruments listed in regulation 2 insofar as they apply to England and Wales. Without these Regulations the instruments made under the Control of Pollution Act 1974 would continue to have effect on and after 1st September 1989 by virtue of the Water Act 1989. Regulations made under that Act re-enact the substance of the revoked instruments.
