The Forestry Commissioners, in exercise of the powers conferred on them by section 9(5)(a) and 32(1) of the Forestry Act 1967[1] and after consultation with the Home Grown Timber Advisory Committee, hereby make the following Regulations: 1. These Regulations may be cited as the Forestry (Exceptions from Restrictions of Felling) (Amendment) Regulations 1998 and shall come into force on 1st April 1998. 2. Subject to regulation 3 below, the Forestry (Exceptions from Restriction of Felling) Regulations 1979[2] shall be further amended by omitting regulation 4(6). 3. Regulation 2 above shall not apply in relation to the felling of trees in accordance with a plan of operations approved by the Forestry Commissioners as part of an agreement between the Commissioners and an applicant for participation in the Woodland Grant Scheme[3] entered into before the date of coming into force of these Regulations. 4. The Forestry (Exceptions from Restriction of Felling) (Amendment) Regulations 1988[4] are revoked. (This note is not part of the Regulations) These Regulations amend the Forestry (Exceptions from Restrictions of Felling) Regulations 1979 by removing the exception in favour of felling in accordance with a plan of operations approved under specified schemes under which the Forestry Commissioners make grants pursuant to section 1 of the Forestry Act 1979. The Woodland Grant Scheme is the only current scheme of those specified. The amendment does not apply to felling pursuant to agreements made under the Woodland Grant Scheme before the Regulations come into force.
