The Secretary of State, in exercise of the powers conferred on him by section 15(1), (2) and (4) of, and paragraphs 1(1)(a) and (c), 1(2) and 3 of Schedule 3 to, the Health and Safety at Work etc. Act 1974[1] and of all other powers enabling him in that behalf and for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the said Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act, hereby makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the Carriage of Dangerous Goods (Amendment) Regulations 1998 and shall come into force on 30th December 1998. Amendments to the Highly Flammable Liquids and Liquefied Petroleum Gases Regulations 1972 2. In regulation 7(7)(a) of the Highly Flammable Liquids and Liquefied Petroleum Gases Regulations 1972[2], for the words "1st January 1999" there shall be substituted "1st July 2001". Amendments to the Dangerous Substances in Harbour Areas Regulations 1987 3. In regulation 24(a)(i) of the Dangerous Substances in Harbour Areas Regulations 1987[3]-
(b) in paragraph (bb), for the words "31st December 1998" there shall be substituted "30th June 2001".
Amendments to the Carriage of Dangerous Goods by Rail Regulations 1996
(b) in regulation 9(1), for the words "31st December 1998" there shall be substituted "30th June 2001"; and (c) in the title to Schedule 1, for the words "1ST JANUARY 1999" there shall be substituted "1ST JULY 2001".
Amendments to the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations 1996
(b) in regulation 3(4)(e), for the words "1st January 1999" there shall be substituted "1st July 2001"; (c) in regulation 21(10), for the words "1st January 1999" there shall be substituted "1st July 2001"; and (d) in Schedule 8-
(ii) in paragraph 3(5), for the words "31st December 1998" there shall be substituted "30th June 2001", (iii) in paragraph 4-
(bb) in sub-paragraph (2), for the words "1st January 1999" there shall be substituted "1st July 2001", and
(iv) in paragraph 5-
(bb) in sub-paragraph (2), for the words "1st January 1999" there shall be substituted "1st July 2001".
Amendments to the Carriage of Dangerous Goods by Road Regulations 1996
(ii) in sub-paragraph (b), for the words "31st December 1998" there shall be substituted "30th June 2001";
(b) in the title to Schedule 3, for the words "1 JANUARY 1999" there shall be substituted "1ST JULY 2001"; and
(This note is not part of the Regulations) These Regulations amend the Highly Flammable Liquids and Liquefied Petroleum Gases Regulations 1972 (S.I. 1972/917), the Dangerous Substances in Harbour Areas Regulations 1987 (S.I. 1987/37), the Carriage of Dangerous Goods by Rail Regulations 1996 (S.I. 1996/2089), the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations 1996 (S.I. 1996/2092) and the Carriage of Dangerous Goods by Road Regulations 1996 (S.I. 1996/2095) to change the date for the application of certain provisions relating to tanks and transportable pressure receptacles from 1st January 1999 to 1st July 2001.
