The Secretary of State, being the designated Minister[1] for the purpose of section 2(2) of the European Communities Act 1972[2] in relation to the regulation and control of classification, packaging and labelling of dangerous substances and preparations, and for measures related to consumer protection, in the exercise of the powers conferred on him by the said section 2(2) and sections 15(1), (2) and (4)(a) of, and paragraphs 1(1)(b) and (4) of Schedule 3 to, the Health and Safety at Work etc. Act 1974[3] ("the 1974 Act") and of all other powers enabling him in that behalf, for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the 1974 Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act, hereby makes the following regulations:
Citation and commencement
1. These Regulations may be cited as the Chemicals (Hazard Information and Packaging for Supply) (Amendment) Regulations 1998 and shall come into force on 6th January 1999.
Amendment of regulation 4 of the Chemicals (Hazard Information and Packaging for Supply) Regulations 1994
2. For regulation 4 of the Chemicals (Hazard Information and Packaging for Supply) Regulations 1994[4], substitute the following regulation-

In these Regulations the "approved supply list" means the document entitled "Information Approved for the Classification and Labelling of Substances and Preparations Dangerous for Supply (4th Edition)" approved by the Health and Safety Commission on 22nd October 1998."

1. These Regulations amend the Chemicals (Hazard Information and Packaging for Supply) Regulations 1994 (S.I. 1994/3247) by introducing a new edition of the approved supply list (which prescribes agreed classification and labelling for many common chemical substances) so as to include mineral wools, refractory ceramic fibres and special purpose fibres in that list.
2. The Regulations thereby implement Commission Directive 97/69/EC (OJ No. L 343, 13.12.97, p. 19) adapting to technical progress for the 23rd time Council Directive 67/548/EEC (OJ No. L 196, 16.8.67, p. 1) on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances.

4. A copy of the cost benefit assessment prepared in respect of these Regulations can be obtained from the Health and Safety Executive, Economic Advisers Unit, Rose Court, 2 Southwark Bridge, London SE1 9HS. Copies have been placed in the library of each House of Parliament.
