LANDS TRIBUNAL, ENGLAND AND WALES

The Civil Procedure (Modification of Enactments) Order 2000

  Made 1st April 2000 
  Laid before Parliament 4th April 2000 
  Coming into force 2nd May 2000 

The Lord Chancellor, in exercise of the power conferred on him by section 4(1) of the Civil Procedure Act 1997[1], makes the following Order - 

     1. This Order may be cited as the Civil Procedure (Modification of Enactments) Order 2000 and shall come into force on 2nd May 2000.

    
2. In the proviso to section 3(4) of the Lands Tribunal Act 1949[2], after the words "rules of court," insert "in England and Wales appeal to the court and otherwise".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Lands Tribunal Act 1949 following the making of a new rule for appeals in rule 19 of and Schedule 5 to the Civil Procedure (Amendment) Rules 2000 (S.I. 2000 No. 221). Appeals from the Lands Tribunal in England and Wales to the Court of Appeal will no longer be by way of case stated.
