CHILD SUPPORT

The Child Support (Applications: Prescribed Date) Regulations 2003

  Laid before Parliament 7th February 2003 
  Coming into force 3rd March 2003 

The Secretary of State for Work and Pensions, in exercise of the powers conferred by sections 4(10)(a), 7(10)(a) and 54 of the Child Support Act 1991[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Child Support (Applications: Prescribed Date) Regulations 2003 and shall come into force on 3rd March 2003.

Prescribed date
    
2. The date prescribed for the purposes of - 

    (a) section 4(10)(a) of the Child Support Act 1991 (applications for child support maintenance: exclusion in respect of existing maintenance orders); and

    (b) section 7(10)(a) of that Act (application by child in Scotland for maintenance calculation: exclusion in respect of existing maintenance orders),

is 3rd March 2003.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations specify 3rd March 2003 as the date prescribed for the purposes of sections 4(10)(a) and 7(10)(a) of the Child Support Act 1991 which preclude an application for child support maintenance under section 4 or, in Scotland, an application by a child for a maintenance calculation under section 7, in cases in respect of which there is in force a maintenance order made before that date.

[1] 1991 c. 48; section 4(10) was inserted by section 18(1) of the Child Support Act 1995 (c. 34) ("the 1995 Act") and is amended by section 2 of, and paragraph 11(2) of Schedule 3 to, the Child Support, Pensions and Social Security Act 2000 (c. 19) ("the 2000 Act"); section 7(10) was inserted by section 18(2) of the 1995 Act and is amended by paragraph 11(2) and (4)(b) of Schedule 3 to the 2000 Act; section 54 is an interpretation provision and is cited for the definition of "prescribed".back
